TR CU confirmation schemes


Procedure for use of typical schemes of evaluation (confirmation) of conformity of Technical Regulations of Customs Union (TR CU) is performed in accordance with the Instruction approved by the Decision of the Customs Union Commission dated April 7, 2011 No. 621 and by the Decision of the Board of the Eurasian Economic Commission dated April 18, 2018 No. 44 “On standard conformity assessment schemes”.

General provisions

Confirmation of conformity (CoC) is performed in the form of certification or declaration of conformity, based on the typical schemes.

A typical scheme for confirmation of conformity is a set of activities (elements), the results of which are used to make decisions on the conformity (non-conformity) of products with the requirements of the technical regulation.

In general, such activities (elements) are:

  • Analysis of technical documentation;
  • Identification, product testing, product type assessment;
  • Production evaluation, manufacturing supervision;
  • Issuance of certificate of conformity, adoption of a declaration of conformity with technical regulations in a single form, approved by the Customs Union Commission;
  • Registration of declarations of conformity;
  • Application of a single product commercialization mark on the market of the member states of the Customs Union;
  • Inspection check-up.

Depending on the typical certification scheme, confirmation of conformity is carried out by an accredited certification body for products, an accredited body for certification of management systems included in the Unified Register of certification bodies and testing laboratories (centres) of the Customs Union.

Investigation of complaints


Complaints Procedure

  1. Acceptance and consideration of complaints is a way to protect the interests of consumers of CB PSRE's services.
  2. Complaint (claim) — an expression of dissatisfaction with the activities of the conformity assessment body on the part of a person or organization with the expectation of response.

    When considering a complaint between the CB PSRE and the applicant, objectiveness, fairness, impartiality and confidentiality are ensured and observed.

    When considering a complaint, CB PSRE's competent employees will participate, who are directly related to the subject of the complaint, as well as concerned representatives of the parties.

    The result of consideration of the complaint in the CB PSRE is the solution of the problem or a reasonable refusal.

  3. Upon receipt of the complaint, CB PSRE performs:
    • registration of appeal;
    • establishing contact persons and stable communication channels for interaction;
    • analysis of the content of the complaint and identification of responsible persons;
    • ensuring confidentiality when considering a complaint;
    • making a fair decision;
    • timely informing the applicant about the decision;
    • accounting, storage of documents and working materials;
    • analysis of the results of work on the complaint;
    • development of corrective and preventive actions to prevent the receipt of repeated complaints.
  4. In case of disagreement on issues related to the main activity concerning the confirmation of compliance with CB PSRE, the applicant has the right to address directly the Head of CB PSRE.
  5. The complaint shall be prepared in accordance with the rules for registration in the prescribed manner.

    The complaint shall indicate the reasons for the disagreement, justify the disagreement with the CB PSRE’s decision, include the documents, etc.

    The complaint is to be submitted by mail, fax or to the e-mail address of CB PSRE's in writing, no later than within 30 calendar days upon the CB PSRE's decision, with which the applicant does not agree.

    Receipt of each complaint is acknowledged by the Head CB PSRE, in accordance with the specified contact details.

  6. The decision on the complaint is issued within 10 working days. The decision on the complaint should contain:
    • in case of full or partial satisfaction of the complaint, the period and method of its satisfaction;
    • in case of full or partial refusal to satisfy the complaint: the reasons for refusal with reference to the relevant legislative acts, regulatory documents and evidence substantiating the refusal;
    • list of documents confirming the validity of the decision.

    In case of disagreement with the decision, the applicant has the right to appeal against it by appealing to CB PSRE or higher authorities.

  7. The decision on the complaint is sent to the applicant's address in writing, no later than within 10 days since its execution, using means of communication that provide a fixed sending, or against receipt.
  8. If no objection from the applicant for the decision was received within 30 calendar days from the date of sending the complaint, then it is considered accepted.

Appeal proceedings


Appeal procedure

  1. Acceptance and consideration of appeals is a way to protect the interests of consumers of CB PSRE’s services. The procedure for consideration of appeals is in the public domain, on the CB PSRE’s website.
  2. Appeal - an appeal by an organization (concerned person) of a decision on a complaint regarding the result of the performance of conformity evaluation work related to the main activity of the certification body, with a request to review the decision taken by this body in relation to this facility.

    The appealer has the right to appeal to CB PSRE with a request to review the decision on the complaint made by this body in relation to this facility based on results of the conformity evaluation work related to the main activities of the body.

    The Board of Appeals functions:

    • upon receipt of appeals in accordance with the rules for registration in the prescribed manner;
    • within the time required for consideration and decision on the appeal.

    The result of the work of the Board of Appeals is the solution of the problem or a reasonable refusal of such a decision.

  3. The Board of Appeals consists of:
    • Chairman;
    • Members, including an independent expert from another organization;
    • Secretary.

    The Chairman and members of the Board of Appeals shall meet the competence criteria and qualification requirements, have at least three years of experience in the field of product certification, whose activities do not apply to the content of the appealer's claim.

  4. The main functions of the Board of Appeals are:
    • resolution of disputes related to CB PSRE’s activities, in connection with the revision of the decision taken by this body in relation to this facility;
    • analysis and resolution of disagreements that emerged during the consideration of complaints.
  5. In case of disagreement between the participants on issues related to the CB PSRE’s activities, the appealer has the right to appeal the CB PSRE’s decision on a complaint to the Board of Appeals.
  6. The appeal shall be executed in accordance with the rules for registration in the prescribed manner.

    The appeal shall include the reasons for the dispute, substantiation for disagreeing with the CB PSRE's decision, indicate documents, etc.

    The appeal should be sent to CB PSRE by mail, fax or e-mail in writing, no later than 30 calendar days upon the CB PSRE’s decision, with which the appealer does not agree.

  7. The Board of Appeals shall consider the appeal within 7 working days from the date of approval of its composition upon the date of registration of the appeal, indicating:
    • information on its receipt;
    • registration number;
    • consideration period (no more than 30 working days).

    The Board of Appeals makes a decision by a simple majority of votes, by open voting, and formalizes it in the minutes of the meeting in an arbitrary form. Based on the minutes of the meeting, the decision of the Board of Appeals is drawn up.

    The solution shall contain:

    • in case of full or partial refusal to satisfy the appeal: the reasons for refusal with reference to the relevant legislative acts and regulatory documents and evidence substantiating the refusal;
    • list of documents confirming the validity of the decision;
    • in case of full or partial satisfaction of the appeal - the period and method of its satisfaction;
    • if the members of the Board of Appeals have a dissenting opinion, it shall be indicated in the decision.
  8. The decision on the appeal is sent to the appellant by the Secretariat’s employee within one (1) working day from the moment of its execution, using communication facilities that provide a fixed sending, or against receipt. A copy of the minutes and the decision of the Board remains in the PCB of NTP Truboprovod LLC.
Rights and obligations of applicants


The rights and obligations of the applicant in the field of mandatory confirmation of conformity in accordance with the Federal Law "On Technical Regulation" No. 184-FZ dated December 12, 2002.

Applicant is entitled to:

  • select the form and scheme of confirmation of conformity provided for certain types of products by applicable technical regulations;
  • apply for mandatory certification to any certification body, accreditation area of which covers the products that the applicant is going to certify;
  • apply to the accreditation body with complaints of illegal actions of certification bodies and accredited testing laboratories (centres), in accordance with the legislation of the Russian Federation;
  • Use technical documentation for confirmation of conformity of products to the requirements of technical regulations.

Applicant undertakes to:

  • provide conformity of products to the requirements of technical regulations;
  • release into circulation products subject to mandatory confirmation of conformity only after competing of such confirmation of conformity;
  • specify in the supporting documentation information about certificate or declaration of conformity;
  • submit to the State oversight (supervision) authorities responsible for compliance with the requirements of technical regulations, as well as to parties concerned, the documents proving the conformity of products with TR requirements (declaration of conformity, certificate of conformity or their copies), or registration number of certificate or declaration of conformity;
  • suspend or terminate sales of products, if the validity of the certificate or declaration of conformity is suspended or terminated;
  • notify the certification body of changes introduce in the technical documentation or manufacturing process of certified products;
  • suspend the manufacture of products that have passed the confirmation of conformity and do not satisfy the requirements of technical regulations, based on decisions of State oversight (supervision) authorities responsible for compliance with TR requirements;
  • suspend or terminate sales of products, if the validity of the certificate or declaration of conformity has expired, except for the products put into circulation in the Russian Federation during the validity period of the declaration or certificate of conformity, during the shelf life or service life of the products, established in accordance with the legislation of the Russian Federation.
Certification cost calculation procedure


When calculating the cost of mandatory certification of products and services, as well as registration of declaration of conformity accepted by manufacturer, OSP NTP Truboprovod follows the Certification Rules “Payment for Certification of Products and Services” approved by Resolution No. 44 dated August 23, 1999 of the RF Standardisation Metrology and Certification Committee (GosStandart).

General provisions.

Payment for certification of products and services is based on the following principles:

  • All actually performed certification work is paid for at the expense of the own funds of enterprises, organizations, persons who have applied for carrying out the relevant work, regardless of the decisions made based on such work results;
  • The profitability level of work on the mandatory certification should not exceed 35%;
  • Inspection check-up of mandatory certified products and services is paid in the amount of actual costs incurred by organizations performing the relevant work.

The daily rate of experts on certification of products and services involved in the implementation of mandatory certification, including work on inspection check-up of conformity of certified objects to the requirements of regulatory documents (RD), taken to calculate the cost of certification and inspection check-up, is determined by the certification body on its own, based on its terms of remuneration of employees.

Payment for registration of declarations of conformity.

Payment for registration of declaration of conformity is performed by manufacturer (seller, applicant) at twice the minimum monthly wage established by the Russian legislation.

As from July 1, 2016, the minimum wage rate used solely to regulate wages is established by the Federal Law No. 82-FZ dated June 19, 2000 (as amended by the Federal Law No. 164-FZ dated June 2, 2016) is 7,500 roubles.

Payment for mandatory certification of products and services.

Carrying out work on mandatory certification of products (services) assumes the following expenditures:

  • Certification body for products (services);
  • Testing laboratory;
  • Certification body for quality systems (production);
  • Services for inspection check-up for conformity of certified products (services) with RD, if inspection check-up is provided for by the certification scheme;
  • Services for certificate issuance.

In general, the total expenditures for certification of a specific product (service) (\( C \)) are determined from the formula:

  • \( C_{об} \) - cost of samples selected for certification tests (destructive), RUB;
  • \( C_{ип} \) - cost of product testing carried out by certified testing laboratory, RUB;
  • \( C_{а} \) - cost of production state analysis;
  • \( C_{ск} \) - cost of certification of production or quality system, RUB;
  • \( {C_{ик}}_{i} \) - cost of one inspection carried out within the scope of the inspection check-up for conformity of the mandatory certified products (services) with RD requirements, RUB;
  • \( n \) - the number of inspections provided for by the inspection check-up program for certified products within the period of validity of the certificate of conformity;
  • \( {C_{иск}}_{j} \) - cost of one inspection carried out within the scope of the inspection check-up for conformity of the certified quality (production) system with RD requirements, RUB;
  • \( m \) - the number of inspections of the certified quality (production) system for conformity with RD requirements, provided for by the inspection check-up program within the period of validity of the certificate of conformity;
  • \( C_{рс} \) - expenses for packaging, storage, disposal, loading and unloading operations, as well as transportation of samples to the test location, RUB;
  • \( C_{д} \) - cost of work on consideration of application-declaration.

The formula for calculating the certification work cost includes only elements that correspond to the composition of the actual workю

Expenditures of OSP NTP for certification of products (services \( C_{ос} \), quality and production systems \( C_{ск} \)) taking into account mandatory certification of specific products (services) are determined from the formula:

  • \( P \) - level of profitability, %.
